Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Traded Inc. (“Traded,” “we,”or “us”) governing your access to and use of traded.gg and the related applications, features, and services (collectively, the “Services”).

By creating an account, connecting a wallet, making a transaction, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. You must be at least 18 years old and legally capable of entering into a binding agreement. You may not use the Services where doing so is prohibited by applicable law.

Traded provides tools to discover, compare, acquire, open, manage, and display trading cards and related collectibles. The Services may aggregate information from third-party marketplaces, enable purchases or pack openings through integrated providers, display estimated values, and offer points, quests, referrals, events, or promotions.

Unless a checkout expressly identifies Traded as the seller, the applicable third-party seller or marketplace remains responsible for the item, custody, fulfillment, authenticity, delivery, and any marketplace-specific remedy. Third-party terms may also apply. Prices, availability, grades, images, descriptions, estimates, and similar listings can change or be incomplete, and you must review the final transaction details before approving a purchase.

You must provide accurate information, keep your account credentials secure, and promptly notify us of suspected unauthorized activity. You are responsible for activity performed through your account or a connected wallet to the extent permitted by law. You may not create accounts through deception, impersonate another person, evade a suspension, or use automation to abuse the Services.

We may require identity, ownership, transaction, or eligibility checks before permitting an action. Usernames, public profiles, referral identifiers, and connected public wallet addresses may be visible to other users. You do not acquire ownership of a username, and we may rename or reclaim one that infringes rights, misleads users, or violates these Terms.

The Services may offer a provider-managed embedded wallet (“Traded Wallet”) and allow you to connect an external wallet. Wallet services are provided with third-party infrastructure. Traded does not control the private keys to your external wallet. You are responsible for protecting wallet credentials, verifying recipient addresses and transaction details, and maintaining sufficient network tokens and stablecoins where required.

Blockchain transactions may be public, irreversible, delayed, or unsuccessful. Network congestion, smart contracts, token issuers, validators, wallet providers, RPC providers, or other third parties may affect a transaction. Traded cannot reverse a transaction that has been submitted to a blockchain or recover assets sent to an incorrect address. Displayed balances may be delayed and are not a bank statement or deposit account.

You authorize the amounts shown at checkout, including applicable price, fees, taxes, shipping, and network costs. Except where required by law or expressly stated by the applicable seller, marketplace, or promotion, completed purchases and blockchain transactions are final. You are responsible for determining and paying taxes arising from your activity.

A buyback or sellback amount is a separate, time-limited offer subject to its stated eligibility, price, and expiration. Keeping, transferring, listing, or otherwise changing control of an item may make an offer unavailable. An estimated value is informational only and is not a promise that an item can be sold for that amount.

Pack contents are randomized and are not selected by the user. Before purchase, review the pack price, stated possible outcomes, applicable odds or methodology, delivery wallet, and any buyback terms. A pack’s purchase price does not guarantee the identity, grade, rarity, market value, or resale value of the item received. Past results do not predict future outcomes.

You may only open packs if permitted by the laws applicable to you. Packs are offered for collectible entertainment and are not an investment product. We may pause a pack, correct a technical error, or void and refund an incomplete transaction where reasonably necessary, subject to applicable law and provider settlement status.

Traded points are promotional loyalty units. They are not money, cryptocurrency, stored value, property, or transferable, and have no cash value unless a specific promotion expressly states otherwise. Lifetime points may differ from spendable points. We may establish, correct, limit, expire, or change point-earning and redemption rules prospectively, and may reverse points credited through error, refund, chargeback, fraud, manipulation, self-referral, or abuse.

Giveaways, raffles, contests, and other promotions may be governed by additional official rules, which control if they conflict with these Terms. Eligibility can vary by location. Promotions are void where prohibited, and no purchase is necessary where required by law. We may verify eligibility, enforce entry limits, disqualify abusive or duplicate entries, and withhold a prize until required verification is complete.

You may not:

• use the Services for fraud, money laundering, sanctions evasion, or other unlawful activity;
• misrepresent ownership, authenticity, price, identity, eligibility, or transaction activity;
• interfere with security, probe non-public systems, bypass limits, scrape in violation of access controls, or introduce malicious code;
• manipulate points, referrals, rankings, promotions, prices, or marketplace activity;
• infringe intellectual property, privacy, publicity, or other rights; or
• use the Services in a manner that could harm Traded, its providers, or other users.

We may investigate suspected violations and restrict, suspend, or terminate access, cancel affected entries or offers, and preserve or disclose information where permitted by law.

Traded and its licensors own the Services, software, design, branding, and original content. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose.

You retain rights in content you submit. You grant Traded a worldwide, non-exclusive, royalty-free license to host, reproduce, format, and display that content only as reasonably necessary to operate, secure, promote, and improve the Services. You represent that you have the rights needed to provide it. Product names, card artwork, marketplace marks, and third-party content belong to their respective owners.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TRADED DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OPERATION, PERFECT DATA, CONTINUED AVAILABILITY OF AN ITEM OR INTEGRATION, OR ANY PARTICULAR FINANCIAL OR COLLECTING OUTCOME.

Content, price estimates, market comparisons, rankings, and analytics are informational and are not financial, investment, tax, legal, or appraisal advice. Collectibles, digital assets, and stablecoins can lose value. You are responsible for your own decisions and due diligence. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, ASSETS, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) US$100 OR (B) THE AMOUNTS YOU PAID DIRECTLY TO TRADED FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING MANDATORY CONSUMER RIGHTS.

We may modify or discontinue features, integrations, rewards, or the Services. We may suspend or terminate access to protect users or the Services, comply with law, address risk, or enforce these Terms. Where reasonably practicable, we will provide notice of material adverse changes. Updated Terms apply prospectively from their stated effective date; continued use after that date constitutes acceptance.

Provisions that by their nature should survive termination—including ownership, transaction obligations, disclaimers, liability limits, and dispute-related provisions—will survive.

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, financing, reorganization, or transfer of the Services. These Terms, the Privacy Policy, and any applicable promotion or transaction rules form the entire agreement concerning the Services.
